The Duties of
The Employer

Article 56, Number 1. Program -
Establish, apply, and maintain the Occupational Safety and Health Program, under the terms and conditions established in this Law, its Regulations, and technical standards. -
Article 56, Number 2. Instruction and training -
Instruct and train workers regarding the prevention of accidents and occupational diseases, as well as regarding the use of personal protection and safety devices, in accordance with the provisions of this Law, its Regulations, and technical standards. -
Article 56, Number 3. Information on risk -
Inform workers in writing of the principles of prevention of unsafe or unhealthy conditions, of the physical, chemical, biological, ergonomic, and psychosocial agents that may affect health, as well as the damage they could cause. -
Article 56, Number 4. Reporting -
Inform the National Institute of Prevention, Health and Occupational Safety and the Institute of Social Security in writing of the occurrence of occupational accidents and occupational diseases, under the terms and conditions established in this Law and its Regulations. -
Article 56, Number 5. PPE -
Provide workers, free of charge, with personal protection and safety implements and equipment of ergonomic design, according to the type of task and the risks, and ensure the correct and timely use of the same. -
Article 56, Number 6. Provision of tools -
Guarantee that the prevention delegates and the Occupational Safety and Health Committee have all the facilities, information, and training necessary for the performance of their functions. -
Article 60. Adaptable tools and workstations -
The employer must adapt the work methods as well as the machinery, tools, and work utensils to the psychological, cognitive, cultural, and anthropometric characteristics of the workers. In this sense, they must carry out the pertinent studies and implement the required changes both in existing workstations and at the time of introducing new machinery, technologies, or methods of work organization in order to ensure that the design of the workstation allows for the development of physical and mental faculties and the protection of the health and safety of the workers.

Article 54, Number 1. Practice safe methods -
Practice the safety and health criteria and procedures established in the workplace and in the corresponding technical standards. -
Article 54, Number 2. Use of equipment -
Use in a correct manner and maintain in good state of conservation the equipment and devices for prevention and safety, as well as the personal protective equipment provided by the employer, in accordance with the instructions and training received. -
Article 54, Number 3. Risk reporting -
Inform immediately of any condition or situation that, in their judgment, may represent a risk or danger to their health or physical integrity, or that of third parties, to the employer or their representatives, and to the Prevention Delegates. -
Article 54, Number 4. Workplace maintenance -
Maintain the workplace in clean and safe conditions, performing their work in a manner that does not represent a danger to their own safety and health, or that of other workers, third parties, or the facilities. -
Article 54, Number 5. Safety reporting -
Inform the Occupational Safety and Health Service of the company about any physical or mental situation that may affect their health at work or the safety of others. -
Article 54, Number 6. Co-operate -
Cooperate and participate in the fulfillment of the preventive measures established by the Occupational Safety and Health Committee and the National Institute of Prevention, Health and Occupational Safety. -
Article 54, Number 7. Participate -
Attend and participate in the training and education activities on safety and health at work that are organized by the employer or the competent organisms. -
Article 54, Number 8. Comply -
Comply with the medical examinations and other health surveillance measures that are mandatory according to the Law, its Regulations, and technical standards.
