The Duties of
The Employer

Factories Act 1974, Article 31
(1) Every owner shall be responsible that all reasonable precautions are taken to ensure the safety of persons employed at the works. -
Employment Act 2023, Part II, Article 5
The Commissioner shall, in the exercise of his functions under this Act, have power to -
(d) issue to an employer, an improvement notice or prohibition notice, on such conditions as may be prescribed, to remedy a defect in plant layout or working methods which in his opinion constitutes to be a threat to the health or safety of a worker; order the temporary seal of a workplace or the discontinuation of a work process—
(i) for non-compliance with relevant labour laws; or
(ii) on an imminent danger to the safety and health of workers;

Article 30
(1) No person employed in a factory or in any other place to which any provision of this Act applies shall wilfully interfere with or misuse any means, appliance, convenience or other thing provided in pursuance of this Act for securing the health, safety or welfare of the persons employed in the factory or place, and, where any means, appliances, convenience or other thing for securing health or safety is provided for the use of any such person under this Act, he shall use that means, appliance, convenience or other thing.
(2) No person employed in a factory or in any other place to which any provisions of this Act apply shall wilfully and without reasonable cause do anything likely to endanger himself or any other person.
