The Duties of
The Employer

Article 5 - Responsibility of health and protection
(1) The employer has an obligation to ensure occupational safety and health for their employees from every aspect related to work. Within their obligations, the employer must take measures necessary for occupational safety and health of employees, including protection from occupational risks, providing information and training, and providing appropriate organization and necessary means.
(2) The employer has an obligation to introduce such protective measures and to select such work and production methods that will improve the level of occupational safety and health, and will be included in all activities of the employer and at all levels of the organization. -
Article 8 - Planning safe processes
The employer is obliged to plan measures and means to ensure the development and improvement of occupational safety and health and to change existing technological processes with less dangerous, or safer processes, and to adapt the measures taking into account changing circumstances to improve existing conditions. -
Article 9 - Risk avoidance
The employer shall implement occupational safety and health measures based on the following basic principles:
- avoiding risks,
- assessing risks that cannot be avoided,
- combating risks at source,
- adapting work to the individual, especially regarding workplace characteristics and work environment and easing monotonous work and work with a predetermined work pace. -
Article 22 - Health examinations
(1) The employer must provide health examinations for employees at least every 24 months.
(2) The type, manner, scope and price list of health examinations shall be regulated by the Government of the Republic of North Macedonia on the proposal of the minister responsible for labor affairs, with prior opinion from the minister responsible for health affairs.
(3) The amount of costs for health examinations, which will be determined in the price list, shall be established based on the type, manner and scope of conducting health examinations. -
Article 25 - Provision of information
The employer must inform employees about safe performance of work through written notices and instructions as soon as possible. In exceptional cases, when employees are exposed to immediate danger to their health or life, such notices and instructions should be transmitted orally and shall include all measures taken regarding occupational safety. -
Article 31 - Provision of Training
The employer must provide every employee with appropriate training for occupational safety and health:
- upon employment,
- in case of transfer to a new workplace,
- in case of introduction of new technology or new means of work, and
- in case of any change in the work process that may change the level of occupational safety and health.

Article 50 - Home work employment contract
(1) Home work shall mean work that the employee carries out in his home or in other premises of his choice, other than the workplace of the employer.
(2) By virtue of the home work employment contract the employer and the employee may agree that the employee shall carry out the work within the scope of activities of the employer, or which is required to pursue the activity of the employer, at his home.
(3) The employer shall submit the home work employment contract to the labour inspector within three days upon the date of entering into the contract.
(4) The rights, obligations and conditions that are determined by the nature of the home work shall be agreed by the employer and the employee in the employment contract.
(5) The employee shall be entitled to a reimbursement for the use of his own resources for home work. The amount of the reimbursement shall be defined by the employer and the employee in the employment contract.
(6) The employer shall ensure the conditions for occupation safety and health in the case of home work. -
Article 51 - Prohibition of home work
The labour inspector may prohibit the employer to organize home work if such work is harmful to the employees who work carry out home work, or to the living and working environment where the work is being carried out. -
Article 52 - Work not allowed to be carried out at home
Work that is not allowed to be carried out as home work may be stipulated by law or other regulation

Article 38 - Rights and obligations of employees
(1) It is the right and obligation of every employee to take care of their own safety and health and the safety and health of other persons working with them and persons affected by their activities, in accordance with the training and instructions given to them by the employer, to be familiar with occupational safety and health measures and to be trained for their application.
(2) It is the right and obligation of every employee to give proposals, opinions and remarks about occupational safety and health to the professional person and authorized health institution.
