The Duties of
The Employer

Article 132, Section XVI
Explicitly requires employers to install and operate factories, workshops, offices, and other places where work is performed in accordance with the regulations and NOMs on occupational safety, health, and the environment. -
Article 132, Section XVII
Obligates employers to comply with safety and health provisions to prevent work accidents and illnesses. -
Article 132, Section XVIII
Mandates the provision of preventive medicines and health materials determined by the law. -
The "Chair Law" (Ley Silla) - 2025/2026 Amendment
Mandates that employers provide a sufficient number of seats with backrests for all employees. It strictly prohibits forbidding employees from sitting during their shift if the nature of the work allows.

The Employer

Provision of equipment - Provide the following to employees under the telework modality:
a) an ergonomic chair or one appropriate for the activities to be carried out
b) necessary supplies for its adequate performance
c) additional adjustments that guarantee adequate ergonomic or postural conditions - Provision of training - Provide training at least annually to employees under the telework modality on the safety and health conditions they must have and maintain in their workplace.

Minimum requirements - To avoid occupational hazards caused by physical agents, employees must have a work area that is:
(a) clean and tidy, without unnecessary materials, objects, or equipment in the workplace
(b) illuminated in a way that does not cause glare or visual fatigue
(c) adequately ventilated and temperature controlled to provide a pleasant environment for the type of activities performed in the working day
(d) free of noise levels that prevent the concentration required to perform work (with the exception of environmental noise under the control of third parties) - Employee list - Maintain an updated list of employees under the telework modality.
- Connectivity - Provide connectivity for the use and management of ICT and maintain adequate safety and health conditions at work, emphasizing the good condition of electrical installations and appropriate lighting, ventilation, and ergonomic conditions.
- Policy - Establish and disseminate a teleworking policy to prevent occupational risks by ensuring safety and health at work; establish mechanisms of communication with employees under the teleworking modality to prevent their social isolation.
- Flexibility - Recognize circumstances related to gender and enable employees to reconcile teleworking with their personal lives
- Reversal - Establish mechanisms for reversing teleworking (including temporarily)
- Compliance - Comply with the Checklist of Safety and Health Conditions in Telework

Checklist validation - Enable the Safety and Hygiene Commission to validate the checklist of compliance with safety and health conditions in telework (including photographic or video evidence); the employer may choose to:
(a) visit the proposed workplace where telework will be done (with the prior authorization of the applicant to be employed under the telework modality and with the facilities that the applicant provides).
(b) provide the Checklist of Safety and Health Conditions for Telework to the applicant employee under the telework modality so that the applicant employee can independently determine whether the requirements of safety and health at work are fulfilled. - Mechanisms - Provide mechanisms for responding to cases of family violence that permit, among other things, a temporary or permanent return to the on-site modality.

The Employee

Article 134, Section I and II
Employees must follow all labor regulations, internal work rules, and Official Mexican Standards (NOMs) concerning safety, health, and environmental protection at the workplace. -
Article 134, Section III and IV
Workers are required to perform their services under the direction of the employer or their representative and must execute their tasks with appropriate intensity, care, and promptness. -
Article 134, Section VI and VII
It is the duty of the employee to return unused materials and maintain all tools and equipment provided by the company in good condition, excluding natural wear and tear. -
Article 134, Section X and XI
Employees must undergo mandatory medical examinations as required by law or internal regulations to ensure they do not suffer from contagious or work-related illnesses that could endanger others. -
Article 134, Section XII and XIII
Workers are obligated to share any technical or administrative improvements they discover and must scrupulously guard technical, commercial, or manufacturing secrets of the employer. -
Article 135, Section I and II
Employees are strictly prohibited from performing any act that endangers their own safety, that of their coworkers, or the establishment, and may not be absent without a justified cause or permission. -
Article 135, Section IV and V
It is prohibited to report to work in a state of intoxication or under the influence of narcotics or debilitating drugs, unless a medical prescription is provided and the employer is notified before the shift. -
Article 135, Section IX
Workers must not use the tools and equipment provided by the employer for any purpose other than those specifically intended for their job functions. -
For Remote Work
Remote workplace check - Enable the Safety and Health Commission to conduct a physical determination of occupational health and safety conditions in the workplace or independently verify the checklist on safety and health conditions in the workplace both before working under the telework modality and periodically thereafter. -
For Remote Work
Information of address - Inform the employer (in writing and in advance) of any permanent or temporary change of address from the previously agreed upon place of work. -
For Remote Work
Risk reporting - Notify the employer and the Health and Safety Commission of any work-related risks encountered.
