This agreement defines workplaces as 'areas where persons remain or must access to perform their work.' This definition implies the inclusion of teleworkers within the regulations of the agreement, but there are no specific ergonomics regulations regarding remote workers.

The Duties of
The Employer

Article 4
Every employer — or their representative, intermediary, supplier, contractor or subcontractor, and third‑party companies — is obligated to adopt and implement Occupational Health and Safety (OHS) measures in the workplace in order to protect the life, health, and physical integrity of their workers. These obligations apply especially with regard to:
a) Work operations and production processes.
b) The supply, use, and maintenance of personal protective equipment, certified under internationally recognized standards.
c) Buildings, installations, and environmental conditions in the workplace.
d) The placement and maintenance of guards, protections, and emergency systems on machines, equipment, and installations. -
Article 5
Employers also have the following obligations:
a) To keep machinery, installations, and work tools in good condition, properly maintained and functioning.
b) To promote training for their personnel in matters of Occupational Health and Safety (OHS), through institutions competent in the subject.
c) To comply with the National HIV/AIDS Policy in the workplace.
d) To place and maintain visible printed materials—such as notices and posters—for the promotion and awareness of OHS. These materials must be promoted and verified by the Ministry of Labor and Social Welfare together with the Guatemalan Social Security Institute (IGSS).
e) To provide workers with the tools, work clothing, and items necessary for the execution of their tasks.
f) To allow and facilitate inspections of workplaces by labor inspectors and OHS technicians from the Ministry of Labor and Social Welfare, as well as safety and hygiene inspectors from the IGSS, in order to verify compliance with the hygiene and safety regulations.
g) To facilitate the creation and functioning of bipartite Occupational Health and Safety Committees.

Every worker is obligated to comply with all Occupational Health and Safety (OHS) rules, instructions, and guidelines whose purpose is to protect their life, health, and physical and psychological integrity. Workers are also obligated to comply with all technical recommendations given to them regarding:
The use and conservation of personal protective equipment that is provided to them;
The operations and work processes indicated for the safe use and maintenance of machinery.
