The Duties of
The Employer
-
The employer shall carry out an analysis of the workplaces in order to assess the safety and health conditions they present for his employees; in particular with regard to the potential risks to the vision, physical problems and mental strain of workers. This analysis also takes into account the problems of particularly sensitive risk groups.
- Employers shall take appropriate measures to address the risks identified on the basis of the assessment, taking into account the cumulative effects and the combination of the risks identified.
- Employers shall request from manufacturers, importers and all suppliers of displays, all information necessary for the assessment.
- Employees and/or their representatives shall be informed of all matters relating to health and safety at their workplaces.
- The employer shall ensure that each employee with visual display screens is provided with training on how to use it before the start of work and whenever the organization of the workplace is substantially modified.
- The employer shall be obliged to plan the worker's activity in such a way that daily work on visual display screens is periodically interrupted by breaks or changes in activity, which will limit the workload on the visual display screen.
- The employer shall consult the workers and/or their representatives on the planning and organisation of work.
Regarding telework:
- During telework the employer takes the cost of the equipment specifically with telecommunications, equipment maintenance and fault repair.
- The employer must inform teleworkers about the enterprise's policy in relation to health and safety at work, which must include in particular the specifications for the teleworking area, the rules on use of screens, breaks, and the organizational and technical equipment and any other necessary information
Regarding medical examination:
- In the context of the supervision of the health of employees, in accordance with the applicable provisions, the employer has the obligation to ensure that each employee is subjected to medical examinations of the vision and musculoskeletal system at the time of recruitment and then once a year as well as when the employees feel discomfort that may be due to their work.
- The employer shall provide workers with special glasses if the results referred to in paragraph 1 make them necessary and if the usual glasses are not suitable or effective for the task in question.
- For particularly sensitive risk groups, additional information and care should be taken to better deal with problems caused by working with visual display screens.
- For pregnant women, there should be additional information and care for the better treatment of problems, psychological mainly during the early stages of pregnancy and ergonomic, especially in the later stages, caused by working with visual display screens.
Chapter C: Miscellaneous Provision
Penalties
as well as temporary suspension of the operation of a specific production process or part or parts or of the entire enterprise or holding for a period of up to 6 days.
In addition, the Minister of Labour may, following a reasoned recommendation of the competent labour inspector, impose on the above a temporary suspension of the operation of a specific production process or part or parts or of the whole of the enterprise or holding for a period of more than 6 days, or a definitive interruption of the operation of a specific production process or part or parts or of the whole enterprise or holding.
Any employer, manufacturer, manufacturer, importer or supplier, who negligently or intentionally violates the provisions of this Regulation, shall be subject to the criminal penalties of Article 25 of Law 2224/94, without prejudice to the provisions of Article 6 of the Joint Ministerial Decision 88555/3293/30.9.88 ratified by Article 39 of Law 1836/89.
Any employer, manufacturer or manufacturer, importer or supplier who intentionally violates the provisions of the legislation on health and safety at work of this law and the regulatory acts issued by the employer shall be punished by…
