To Note
Cuba does not have a single “ergonomics act,” but ergonomics regulation is integrated into its Law No. 116, Labour Code. At the time of writing, there is no specific regulations for remote workers.

The Duties of
The Employer

Article 127 - Legislation Compliance
- The employer is obliged to comply with the legislation on safety and health at work and to adopt the measures that guarantee safe and hygienic working conditions, as well as the prevention of work accidents, occupational diseases, fires, breakdowns or other damages that may affect the health of workers and the work environment.
- The Code Regulations establish the procedure for controlling risks at work. -
Article 134 - Risk assessment
The employer, after hearing the opinion of the union organization, is obliged to identify and evaluate the risks at work and carry out preventive actions to reduce or avoid them. -
Article 135 - Health and Safety Instruction
- The employer is obliged to give instruction to workers on the risks at work and the procedures to perform their work in a safe and healthy manner.
- Workers have the right to receive instruction on safety and health at work and the duty to comply with it. -
Article 138 - Medical examination
- It is the employer's obligation to require workers to undergo medical examinations to determine if they are physically and mentally fit for the work in question.
- Workers have the right and the duty to undergo medical examinations on the dates designated to them.

Workers have the right to work in safe and hygienic conditions. They participate in identifying and assessing workplace hazards and comply with the measures established to prevent accidents and occupational illnesses. -
Article 135 - Health and Safety Instruction
Workers have the right to receive instruction on safety and health at work and the duty to comply with it.
