The Duties of
The Employer

Art. 236.
The employer is responsible for implementing preventive measures for occupational safety and health designed to ensure the protection of the workers they employ.
In order to provide and maintain a safe and healthy working environment and within the framework established by the national occupational health policy, the employer must, in consultation with the workers' representatives within the company, define, implement, and periodically review a program for preventing risks present in the workplace.
When several employers simultaneously carry out activities in the same workplace, they must collaborate to ensure the most effective protection possible for all workers.
Each employer is responsible for damages caused by their activities. -
Article 238
The employer is required to provide workers with a healthy and suitable working environment and to ensure that workers have working conditions that guarantee their productivity.
The employer is required to provide workers with the facilities and equipment appropriate for the work to be performed and to maintain the premises in such a way as to ensure adequate protection for workers against workplace accidents and any harm to their health.
The employer is required to provide workers, when the performance of the employment contract so requires, with adequate and hygienic living, housing, and catering conditions that ensure their health.
The employer is also required to ensure that workers, taking into account their activities, have access to, maintain, and renew in a timely manner, recognized effective individual and collective protective equipment. -
Article 239
Upon hiring or the introduction of a new work process, the employer is required to provide workers with all information concerning the risks involved in their respective occupations and the measures to be taken to avoid them, including the use of protective systems.
Workers must receive appropriate training in occupational safety and health to inform them of the risks of their work and the means of preventing them.
Furthermore, ongoing information is provided to workers, in possible collaboration with the relevant departments of the ministries responsible for labor andsocial security, the most representative employers' or workers' trade unions, and any organization concerned with occupational safety and health issues.

Article 241
Every worker is required to comply with the provisions of laws and regulations relating to occupational safety and health, as well as the instructions in the company rules, particularly with regard to:
• the performance of work;
• the use and maintenance in good condition of the equipment, machinery, and installations made available to them;
• the use and maintenance of the personal protective equipment provided to them. -
Article 242
Workers are prohibited from:
• preventing or hindering the application of occupational safety and health measures prescribed in the workplace;
• altering, removing, destroying, or deleting notices or instructions posted in the workplace and alarm systems installed there. -
Article 244
Workers have the right to withdraw from the situation and immediately report to their direct supervisor any situation which they have reasonable grounds to believe presents an imminent and serious danger to their life or health.
Workers and their representatives are protected against all disciplinary measures resulting from actions taken in good faith regarding occupational health and safety.
