The Duties of
The Employer

Article L.167
The provisions of this Title and of decrees and orders issued for its application apply to all establishments of any kind employing workers as defined in Article L.3, as well as to educational, vocational training, and apprenticeship establishments, health and hospital establishments, and certain public service positions whose list is fixed by decree. -
Article L.168
Decrees shall determine:
1° General and specific protection, prevention, and sanitation measures applicable to all establishments and positions;
2° Measures relating to the organization and functioning of bodies tasked with helping to observe hygiene and safety requirements and with improving working conditions and protecting workers' health;
3° Measures relating to the display, sale, or transfer, on any basis, of machines, equipment, and various installations that present dangers to workers;
4° Measures relating to the distribution and use of substances or preparations for industrial use that present dangers to workers.
A decree may fix specific requirements for certain professions or types of hazardous equipment, substances, work processes, or installations, or for certain categories of workers. -
Article L.169
The employer is responsible for applying the measures required by this Title and by texts issued for its application. -
Article L.171
The employer must ensure that workplaces, machinery, materials, substances, and work processes under their control present no risk to the health and safety of workers.
Prevention is ensured:
1° By technical measures applied to new installations or processes upon their design or implementation, or by technical additions to existing installations or processes;
2° By measures relating to the organization of occupational medicine;
3° By work organization measures. -
Article L.172
Where measures taken under Article 171 are insufficient to guarantee workers' safety or health, individual protective measures against occupational risks must be implemented.
Where such individual protective measures require the worker to use appropriate equipment, it must be provided and maintained by the employer.
In such cases, no worker may be admitted to their workstation without their individual protective equipment. -
Article L.177
All workers:
1° Must be fully informed of occupational risks at their workplaces;
2° Must receive adequate instructions on the means available and the conduct required to prevent and protect against those risks.
This information and these instructions must be communicated to workers in conditions and in a form that allows each of them to have a good general basic understanding of workplace hygiene and safety. -
Article L.182
Hygiene and safety measures and training or information activities are exclusively at the employer's expense.
