The Duties of
The Employer

Article 152‑2
Every employer is required to take the necessary and appropriate measures for the protection of workers and for the prevention of occupational risks.
The employer must, in particular:
- Ensure the protection of workers’ health in the workplace;
- Guarantee adequate working conditions and a suitable work environment;
- Protect workers from risks inherent to machines, equipment, and products used in the enterprise;
- Provide appropriate collective and individual protective equipment and train workers in their use;
- Inform and raise the awareness of workers about the risks associated with the profession they perform. -
Article 154‑5
The employer is required to appoint a workplace safety officer within the enterprise, who is specifically responsible for:
- Ensuring the application of legal, regulatory, and contractual provisions related to workplace safety;
- Supervising the implementation of workplace safety programs;
- Inspecting and monitoring the workplace to detect sources of danger and reporting them in order to prevent risks and ensure the use of prevention equipment;
- Identifying the causes of occupational accidents and proposing measures to prevent them and to ensure worker safety within the enterprise; Training workers in the use of prevention equipment;
- Carrying out awareness‑raising and the dissemination of preventive education among workers.
The safety officer may perform these duties either full‑time or in addition to their primary job. The categories of enterprises required to appoint a workplace safety officer and the qualifications required for this role are determined by decree, after consultation with the relevant professional organizations of employers and workers.
