Poland does not have a single standalone "ergonomics act". Instead, ergonomics requirements are embedded in Poland’s occupational safety and health (OSH) framework, primarily through the Labour Code and the Regulation of the Minister of Labour and Social Policy.

The Duties of
The Employer
- Minimum monitor requirements - The employer is obligated to organize new work positions with screen monitors in such a way that they meet the minimum safety and occupational hygiene requirements and ergonomics specified in the attachment to the Labour Code.

Conduct an assessment - The employer is obligated to conduct an assessment of work positions equipped with screen monitors taking into account work conditions and requirements specified in:
1. Work organization at work positions, including arrangement of equipment elements, in a manner ensuring fulfillment of safety and occupational hygiene requirements.
2. Condition of workstation equipment elements, ensuring safety and occupational hygiene at work, particularly protection against electrical hazards.
3. Workload burdens of visual and skeletal-muscular workers.
4. Worker burdens with physical factors, particularly related to inadequate response.
5. Psychological burden of workers, resulting from work organization methods. - Assessment after changes in work - The assessment mentioned above should be conducted in detail for newly created positions after each organizational change and for existing work positions. Based on the assessment, the employer is obligated to make decisions aimed at eliminating identified hazards and inconveniences.

Information sharing - The employer is obligated to:
1. Inform workers about all aspects of occupational safety and hygiene at screen work positions, including results of assessments mentioned above, and all measures related to safety and occupational hygiene protection.
2. To train workers in the field of safety and occupational hygiene in specific detailed provisions. -
Work organization and breaks - The employer is obligated to provide workers:
1. Connection of alternating work related to screen monitor operation with other types of work not requiring visual strain and performed in other body positions — for at least uninterrupted prescribed work time of screen monitor operation, or...
2. At least a 5-minute break, counted towards working time, for each hour of work at a screen monitor. - Eye care - The employer is obligated to provide workers with eye correction glasses, in accordance with medical recommendations, if examination results show their need for eye care.

Manual handling - The employer must:
1. Assess risks arising from manual handling and physical effort.
2. Avoid or reduce excessive physical load through work design.
3. Introduce mechanical aids or organizational measures where necessary.
4. Adapt physical work tasks to employees’ capabilities.

The Employer
🏠 for Remote Work
- Materials and work tools - The employer will be obliged to provide the remote employee with materials and work tools, including technical devices, necessary for remote work.
- Private work tools - The Act also provides for the possibility for the employee to use private work tools (e.g. a computer) in the event that both parties to the employment relationship so agree, provided that the employee's private technical devices and other work tools used by him for work ensure work safety. In this case, the employee will be entitled to a cash equivalent in the amount agreed with the employer.
- Installation and maintenance - Provide installation, service, maintenance of work tools, including technical devices, necessary for remote work or cover the necessary costs related to the installation, service, operation and maintenance of work tools, including technical devices necessary for remote work, as well as the costs of electricity and necessary telecommunications services.
- Costs - Cover other costs directly related to the performance of remote work, if such an obligation is specified in the agreement (concluded with trade unions) or regulations (or in the absence of an agreement or regulations - in the instruction issued or agreement concluded with the employee).
- Training - Provide the remote employee with the training necessary to perform this work and technical assistance.
- Integration - Enable the remote employee to stay on the premises of the workplace, contact other employees and use the employer's premises and equipment, the company's social facilities and social activities (on the terms applicable to all employees).
The Duties of
The Employee

Employee responsibilities - The main responsibility of the worker is to comply with occupational safety and health provisions and rules. In particular, the worker is required to:
1. Be familiar with OSH provisions, participate in training courses and follow instructions in this field.
2. Perform work in compliance with OSH regulations.
3. Follow the instructions and guidance of his supervisor in the field of OSH.
4. Maintain all machines, devices, tools and equipment in proper condition.
5. Keep the workplace clean and tidy.
6. Use collective protective equipment.
7. Use the provided personal protective equipment, working clothes and shoes in accordance with their intended purpose.
8. Undergo pre-employment medical examinations, periodic medical examinations and check-ups.
9. Immediately notify his supervisor of an accident or a threat to human health noticed in the workplace and warn co-workers and other persons in the immediate area about the danger.
10. Work together with his employer and supervisor in fulfilling the occupational safety and health responsibilities.
